Justice delivered in Masambuka’s death

High Court Judge Justice Dorothy Nyakaunda Kamanga has convicted all the 12 accused persons in the case they were charged of murdering Mac Donald Masambuka, young man with albinism in Machinga in 2018.

The 12, were answering seven different counts ranging from murder to trafficking in persons.

Among them are Alfred Yohane and blood brother to the deceased, Kassim Masambuka who have been convicted of murder while Catholic priest, Thomas Muhosha and police officer, Chikondi Chileka have been convicted of transacting on human tissues.

Machinga District Hospital clinician, Lumbani Kamanga, has been convicted of causing someone to commit a crime against a person with disabilities.

In her ruling, Judge Nyakaunda Kamanga said the court has proved beyond reasonable doubt that the accused committed the offence with intension to cause death.

Meanwhile, the court has adjourned the case to May 31 when both the prosecution and defense are expected to make their sentencing submissions.

In his comment, Director of Public Prosecutions, Steven Kayuni, said he was convinced with the ruling.

And on the other hand, Director of Legal Aid Bureau, representing some of the accused persons, Masauko Chamkakala, said he has received he has received the judgment will respect it.

The convicts were arrested in March 2018 while the hearing of the case was concluded in February 2020.

The late Masambuka went missing on March 9 2018 and his body was later found buried in a garden the following month near Makawa village in the area of Senior Chief Mkowola.
