Court reserves ruling in Chisale assets forfeiture case

Supreme Court Judge, Justice Ivy Kamanga has reserved her ruling to Wednesday next week in a fresh application made by former president Peter Mutharika’s private bodyguard Norman Chisale who wants the court to stop civil proceedings in a case which the State wants his assets worth K5 billion forfeited.

In November this year, the High Court sitting in Blantyre dismissed with costs Chisale’s application to stay his property forfeiture case pending conclusion of another criminal case, which he says is bordering on the same property.

In the application filed through his lawyer Chancy Gondwe, Chisale fears that the civil case would violate his constitutional right to remain silent which he is exercising in another criminal case.

But speaking to YFM outside the court, the Attorney General Thabo Chakaka Nyirenda, said they objected to the application saying stopping the proceedings would pose a huge risk to the property in question and they want the application dismissed with costs.
