Speaker of the National Assembly Catherine Gotani Hara says Parliament is yet to be officially served with a court order which Mangochi South West lawmaker Shadric Namalomba obtained which, among others, is ordering the House to relocate the claimant to his previous seat number 25 in the House.
The revelation follows commotion that instituted in the Chamber in Thursday after Namalomba relocated to the said seat which prompted Leader of Opposition Kondwani Nankhumwa to stand on a point of order asking Speaker’s direction on the matter.
In her ruling, Gotani Hara said the House is yet to be served with the court order and that the House cannot be served with such court orders when a meeting is in session, she then asked Namalomba to go back to his current number 100 seat at the back.
Meanwhile, Democratic Progressive Party (DPP) legislator for Zomba Chisi who is also shadow minister of information and digitalisation Mark Botomani has described Namalomba’s conduct as disorderly.
“My emphasis was that the House should not set a bad precedent in the sense that he should be disrespecting the leadership of the House.
Seats on the opposition side are supposed to be allocated by Leader of Opposition in accordance with Standing Order 39 (4) so the Leader of Opposition has such powers,” said Botomani.
Besides, the court order has also stayed Nankhumwa’s shadow cabinet appointing decision on the basis that the appointments were made without consultation and approval from the DPP.
Meanwhile, Gotani Hara says once the House is served with the order, it will seek legal advice from the Attorney General.
