Man jailed for raping 16-year-old niece

The First Grade Magistrate Court in Dowa has sentenced 26-year old Katiwell Chazama to 8 years imprisonment for raping and impregnating his 16-year-old niece.
State prosecutor Inspector Christopher Daluni told the court that Chazama committed the offence on October 20, 2020.

“The accused took advantage of the situation and told her that if she wanted any assistance from him, she must accept to have sexual intercourse with him,” he told the jam packed court.

“The victim could not resist the situation due to poverty and she is now 6 months pregnant after undergoing medical examination at Dowa District Hospital.”

The convict pleaded guilty to a charge of rape contrary to Section 133 of the Penal Code leading to his conviction.
Presiding over the case, First Grade Magistrate Amran Phiri quashed the convict’s mitigation factors for a lenient sentence, and hence sentenced him to 8 years imprisonment with hard labour as a deterrent to others with similar intentions.
