Court fines doctor in ex-MASM boss defilement case

Blantyre Chief Resident Magistrate Jean Kaira has ordered Dr. Noel Kayange to pay a fine of K10,000 for contempt of court after he failed to show up in court today to testify in a defilement case involving former Medical Aid Society of Malawi (MASM) boss, Andrew Ngomwa.

Dr Kayange was a consultant doctor for Ngomwa, who was convicted for defiling his niece and he is awaiting sentencing.

Earlier in the morning, Dr Kayange failed to show up in court, a development which forced Chief Resident Magistrate Kaira to issue a warrant of arrest and the police were ordered to drug him to court in the afternoon.

However, his lawyer who represented him in court during the afternoon, Bruno Matumbi, told the court that it was not the intension of his client to defy the court older but he is in Lilongwe where he is meeting officials from Norwegian Embassy about a certain research project.

Matumbi further said his client had already communicated to the court, through a letter dated March 10, that he was not going to be available today because of the said meeting.

Meanwhile, the court has set March 28 as a date which Dr. Kayange will appear in court to testify.

Furthermore, the court has also set April 4 as the date for its ruling as to whether the sentencing of Andrew Ngomwa should be committed to the High Court for a stiffer punishment as requested by the state.
